Why discriminate 18 and younger? It should be for none or all. Same for motorcycles. The Day everyone required to wear a helmet why on a motorcycle will be the Day everyone is required to wear a safety harness when stand hunting! I remember when there was such a day,then they changed it....Just saying

This morning at Sharon Elementary in Newburgh, Governor Holcomb conducted a ceremonial signing of HB 1200 "Kate's Law", protecting our children by requiring that a helmet is worn by all ATV operators under the age of 18. This event was attended by hundreds of local citizens, State Senators, State Representatives and Law Enforcement agencies.

Hospitals write off billions of dollars a year for injured an uninsured persons. Thats the reason behind seat belt laws and helmet laws. This one is no different. Motorcyclists just have better lobbyist in Indiana. Sounds like they need to go BACK AND GET RID OF BAD LAW forcing the working, saving, responsible citizens to carry the water for low lifes and dead beats rather than just stove piping on fix after fix for a law that was bad to begin with.

I wish they'd ban 4 wheelers on all public roads and lands on top of that they should require all riders to wear a helmet. I'm tired of hearing about kids getting hurt, tired of seeing people drive them where they're not supposed to be and tired of the dumb things people do on them. I can see the need for one for farming and work I see no need for one beyond that. I'm not saying every person on a 4 wheeler is an idiot but idiots on 4 wheelers sure do stand out. I know that'll be a very unpopular position on this but I'm not running for president either. You ALMOST had that right.

It's a simple law that really doesn't effect most on here. If you're over 18, it doesn't include you. If your kids are riding, I hope you were already taking the precaution.
The biggest thought provoking part is will tickets be written under this law? If so, at any time kids are caught, just during other violation instances, or just during accident investigations?

Great question. I wonder if the law was created for a tax incentive, verses safety. Since they chose to put an age number on it. I think it is a tax and all times will be ticketed-taxed. If an accident investigations, then why under 18? My #1 issue the the 18 age. I guess politics under definition of a adult, verses children. Another way to tax-fine-ticket tear down the middle class families. Picking on the children of families! I better law would be for all riders and only fined per an accident. Then this ticket/tax would help the cost of the investigation.

It's so adults who have to pay for their kids tickets tell them "if you don't wear your helmet and get a ticket I have to pay I'm gonna tan your hide!"

If it was for safety it would not have an age limit. This is my end on this thread. www.cpsc.gov/s3fs-public/atv_annualReport2015.pdf From 1982 through 2015, CPSC staff received reports of 3,163 ATV-related fatalities of children younger than 16 years of age. This represents 22 percent of the total number of reported ATV-related fatalities (14,129). Per CPSC the age group 16 and above needs the helmets. Around 78 of the accidents.

Ive receive a lot of emails about this as I was signed up for the ATV instructor course (which i didnt attend for a family emergency) and the nature of my work I know people.
The driving force behind this was obviously the Play for Kate group, the trauma centers local to Evansville and the Vanderburgh county Health department....at least it was for the initial stages.
What the legislature intended is anyones guess. I would say you can take a majority of genuine concern, and equal parts hospital revenue and ticket revenue and youll have your answer to the law.
In the end, nobody likes seeing dead kids. Trust me, I have and it sucks.

A multitude of bad decisions contributed to her death, but each was against a law that someone doesn't think we need. Not doing just one of the three could have saved her life. This, like all others, can be ignored but hopefully since it has become a law more people will participate.

Hard to believe and 18 year old made a bad decision and ignored a law, every one else has to put up with, and died for her trouble.
I bet every one of those laws she ignored was sold to the public as a life saver.

Like helmet laws, life jacket law, seat belt law, that stupid one buck rule, hunting laws like, seasons, spotlighting, possession limit, the dumb catfish rule now, speed limits, taxes (city, county, state, federal), carry permits, heck I'm 18 maybe I should walk in a Federal building and scream out I have a firearm on me. Wow wake up people. Common sense isn't so common. It's a LAW, just like any other LAW. When it not followed. Right a ticket. Every time.

I saw something new this weekend. I passed a guy on a razor with a kid in a car seat beside him. The kid was strapped in just like in a car, but no helmet.
Do manufacturers make helmets small enough for a proper fit on kids that young?
