From everything that's been discussed in the CO forum, if they are below the "normal high water line" (usually defined as the start of vegetation) they are fine. To me, it appears as though they were OK...

We were on an island/sandbar.......perfectly legal. I've spoken to the ICO for this county, and he stated that unless the island is posted, than it's perfectly legal to be on. There are a few islands that are posted and ARE private property if the deed to their land is of such age that it had the island as part of their privatly owned land. His advice was, go ahead and hunt it unless it's posted. Thanks for the concern though.

Up here, I was told,, and this is a direct quote from GOD!!!! "you step on that island,,, and I got ya!!!" but the sand bars and gravel runs in low water was fine,, anything with vegetation up here worries me

I have been told both stories, from 2 CO's that worked together. It is best to get it strait from the man who will be responding. Or get permission or let the adjacent landowners know before hand just to mitigate any problems.
I don't have enough time or money to fight a stupid arrest to prove I was right. An island can and is outside of normal highwater mark, just depends on who is enforcing the law that day as to how far it will go. I was even told I could be arrested for trespass while on a sandbar. This was from an ICO as well. Best be proactive in these situations. Despite the saying it isn't always easier to beg for forgiveness then to ask for permission.

Guys...... I didn't post the pics of the hunt in order for the entire Watefowl community to scrutinize them with a surveyors level to see if I was legal or not. You folks don't know that I didn't have permission to BE on the shore. Like I said, I TALKED TO THE C.O. via a phone call 2 weeks ago about this issue. I'm perfectly legal where we were...... you see that steep bank across the water? Had we been up there, than we wouldn't have been legal. SOME (not all) of you guys need to enjoy the pictures and stories and stop being so friggin' hyper-critical of what's seen and written. It's almost as bad here as it is in the deer section when someone posts a pic of a large buck......everyone jumps the gun looking for violations and rumors about how illegal the buck is. If I wanted an investigation I'd call out C.S.I. to analyze my hunts!

I did enjoy the pics just responding to some of the comments. And passing on some of the responses I have been given when asking what I could do. My point is don't rely on one CO to give you the final answer for different areas as many have different intrepretation of the law, no matter how you or I read the laws.

hey bsutravis, i"m starting to like the waterfowl stories, keep them coming, i feel like i have been missing out on some great fun in the waterfowl world, i especially love your photos,you can get some great shots where most folks don"t go! photos and hunting stories ,i just love them!!! keep them coming we all enjoy them!!
