If you have no intention of confining the deer , and apparently don't care about trespassers , then why would you spend so much money on a fence that's going to do nothing but cost money to put up ? You can tack "POSTED - No Trespassing" signs on trees or even the occasional wooden stake , so why build a barrier(fence) that you don't intend to use or maintain ?
If you aren't preventing deer from escaping or otherwise confining them , aren't baiting or otherwise breaking the game laws , then I see no problem .

If your trying to keep just the "common thief" out of your property, then why not string an orange cable or chain around the perimeter of your property that is 2-3' high so they have to climb over it . You could post signs all along this barrier. This would eliminate the "I didn't realize I was on your property" arguments some trespassers use, plus it will not cause you any trouble with the deer on the property, meaning no one will think you have a "high fence" preserve. Just an idea.

I'm not sure where you've read that the fence wasn't intended on keeping out trespassers. I'd ddin't mean to say that it wouldn't be mainted, just not a weekly (summer months) chore. Lug

No fence will ever stop a trespasser as long as you can buy a cheap pair of bolt cutters , so whats the point of it ? The best barrier you could put up is a simple clearly visible sign every 50 feet that says "POSTED" and enforce it . Anything more than that is just a waste of time and money . You'd get much better protection by buddying up with a local cop or CO and allowing them to hunt the place whenever they want , and it won't cost a dime . Once the word gets out that a cop or CO hunts there you'll probably never have a trespasser again .
