I was on the way to pick up my daughter from basketball practice just now. I see a car and a semi with hazard lights on,on a state road. I drove by slowly and see a buck with half of a rack, obviously paralyzed in the middle of the road. I just drove on by. Question is: Is it legal to finish off an obviously critically injured deer? I hate to see anything suffer, but I would HATE even more to get a ticket for doing the "right" thing.

Don’t believe it is. You have to call police or conservation officer.

Don’t believe it is. You have to call police or conservation officer. I think you are correct, it's not worth taking a chance.

Came upon a car stopped years ago. Caddy hit a doe. Lady got in car and drove off. Couldn't let her suffer. Threw a jacket over her head and punctured her lungs with a knife to put her down. I'll pay the fine if they'd want to take it that far.

It needs to be reported. Simply because, could you imagine how many guys would stumble across "wounded deer" and have to put them down. Yes, there would be a few scenerios as stated above but, the poaching would get far out of hand.

Dispatch said specifically I couldn’t shoot it. Several hours went by no CO. I shot her. No way, couldn’t take it. Did the right thing. CO never showed up. Ever. Fine me. I’ll take it to court and win.

I had the same thought of the wounded Mooresville deer. But on the other hand, can you imagine the story if I had put the deer out of his misery an hour sooner? Especially on a deer that caliber. It crossed my mind, but made me far to nervous to pull the proverbial trigger.

I'm sure there's plenty of good guys that will do the right thing.

All things being equal, usually nothing good comes from using a firearm in public.

Legally, no. It would be considered hunting deer with a weapon out of season.
BUT, it's not that simple. I hit a deer a few years ago and crippled it in early October while I was headed out to go bow hunting. I did the HUMANE thing and shot it. Then I called 911 and got connected to the wrong county. They took a message and I told them I put it down. The correct county called me, I told them I hit and deer and put it down; they dispatched a deputy to my location.
When the deputy arrived he asked if it was still alive, and I told him I had put it down. He asked me what with. I told him a .357 and asked him if he wanted to see my carry permit. He said, "no, I don't see a gun." He then wrote up a roadkill tag for me and was happy I was able to pull down in the ditch and drag the buck into the truck so he didn't have to help load it and get blood on his uniform.
I asked a friend of mine that is a cop for the town I live close to, and he said he prefers for people to put deer down so he doesn't have to. If he discharges his firearm, he has a bunch of paperwork he has to fill out.
Obviously, YMMV.

My wife hit a doe on way home after picking up my daughter. It took me about 15 minutes to get there. Half hour later the deputy finally got there. I had looked the doe over and saw blood coming from her anus. She was dragging herself with her front legs. If I had been carrying that night I would have finished her off. I turned down the doe because of where she was bleeding from. Coyotes had her cleaned up in a couple of days.

I get the whole poaching thing but I'm not letting an animal suffer. Now the firearm discharge rules in some areas may make the manner of putting an animal down differ. I find it interesting that when it comes to putting a deer down some people are a bit nervous but will not hesitate to put down a coon, possum, cat or dog. I won't even let a possum suffer. Well placed tire or a handy stick. Even had to put a neighbors cat down at 4 in the morning a couple weeks ago. Probably shouldn't have chose something with that loud a boom but all that was handy. The deer I have put down I just do the deed and continue on my way. The mooresville buck mentioned, I'd of done the same under whatever guidelines within the city and said there's the deer.

About 12 years ago coming home from opening day there was a deer on the side of the road dieing and we stopped. The cop had me shoot it so he wouldn't have a bunch of paper work for discharging his gun.

I won't watch an animal suffer when I have a way of ending it.

Call it in and let them know you have or are going to put it down. If a local officer is close dispatch will tell you to wait for one to get on scene. I've had local loes ask my to finish them off so they don't have to fill out the paperwork for discharging their weapon. Sevel of my local deputies carry personal owned deer slugs to dispatch deer so they don't have to fill out the report for the department ammunition, just radio log the gun fire.

I’ve called it in and asked permission before if officer was not within a minute. Was given green light and to stick around for officer if I wanted salvage tag

In today's world, I wouldn't put it down without first calling it in, getting permission and the name of the dispatcher who said it was OK. Cell phone cameras, discharging a firearm within city limits, shooting a deer with a non-legal weapon, etc., etc. all come to mind first. I get it - putting the suffering animal out of it's misery, but on the flip side of the coin I sure don't want to have to pay $1,000's because I did it either.
