I was watching a video for Scentballz and the guy said the food scents will have to be used in a diffuser or whatever he called it, because it could be considered baiting. He specially said Indiana when mentioning this. Is using a scent considered baiting? Is using a food scent considered baiting? If so why? And how would that affect other scents/scent products? ie nose jammer, dead down wind, upwind, etc.

Scents are NOT considered bait. Bait is anything used to attract the deer that may be "consumed" by the deer. Understand the deer does not have to consume the product but the product is available and accessible to the deer to consume if it so chooses. I have posted the administrative code below.
(u) An individual must not hunt deer with the use or aid of: (1) bait, which includes: (A) a food that is transported and placed for consumption, including, but not limited to, piles of corn and apples placed in the field; (B) a prepared solid or liquid that is manufactured and intended for consumption by livestock or wild deer, including, but not limited to, commercial baits and food supplements; (C) salt; or (D) mineral supplements;
