Okay, I am new to the board I know but have a situation that I would like to discuss.
I live in a rural area and have a shared pond. The other day I get home from work and the wife is tearing the house apart looking for a dead mouse. Long story short I figure out the smell is from a fish kill at our pond.
My youngest counted numerous dead fish. The smell was from them and the pond is less than 20 foot from my back door. I went out and tried to gaff them, but they wouldn't sink.
I then went in and grabbed some bird shot and a 12 gauge. I was shooting straight down and knocking them out. A neighbor decided to call the not so local PD.
Not a problem as I know I can discharge on my land. After listening to the PD tell me that I needed to inform the neighbor across the pond before I shoot anything next time I started to wonder about the discharge into the water.
I was not shooting over a body of water, nor was I 'hunting' anything in my pond. I was always on my property and no chance of a round hitting someone else's property. This was also not after dark.
I am wondering if this would be a legal shoot situation... even though it cured the stink in my house.
Any help in this would be appreciated. The same person threatened to turn in another neighbor for shooting a BB gun.

The law only restricts shooting across a body of water, except in the lawful pursuit of game. It does not address shooting INTO the water. However, shooting into the water could be 'misconstrued' by others as recklessness with a firearm, including the officer who responded to the call. IMO, if there are no homes, structures, roads, or people, etc. in the background behind/beyond the direction of the shots, there technically should be no violation, given that there are no other circumstances involved.
