This was a few years ago, but still bears asking.
I had a couple buddies written tix for not wearing orange while hunting. It was a crock and I'd have fought it. They were in a canoe, with their muzzleloaders uncapped. They pulled their hoods up while paddling to their hunting spot. Got out... exposed their orange, and capped their ML's. When they got back to the boat ramp... the CO wrote them up for hunting without orange.
What say you to that?

I'd say that considering the violation was only a class D infraction, with a maximum civil penalty of $25, they should probably buy hunter orange hooded sweatshirts. Hunter orange has to be worn as an OUTER garment. It is not an outer garment if worn under a hood. I wasn't there, so I can't comment on the encounter.
