My father owns a small pond and has muskrats in it and would like to get rid of them. He has been told to take a .22 and just shoot them would this be legal.

As long as the pond/lake belongs to him, he can take/kill nuisance muskrats that are causing damage to his property. If the lake has several adjacent owners, then he can only do nuisance work on his portion of the lake. Of course, he needs to make sure he has a safe backdrop behind his intended target before shooting....
