On a navigable waterway, and below the "normal high water mark".........then yes. Generally speaking, you don't have a whole lot of room to use between the normal high water mark on each bank. A rule of thumb is "where vegetation starts to grow". If you are in that, then you are trespassing unless you have consent from the landowner.
