The 40 cal. bore, minimum is 44 cal.

Surely, the current laws are to keep a 32 or 36 cal roundball squirrel rifle out of the deer woods. A modern bullet would be fine.

There are stupider laws out there. For instance in Colorado, during regular rifle season you cannot use a modern muzzleloader with a sabot, smokeless rifle powder, or any muzzleloader with any magnification optic sights.

With all the Gun & Bow changes in the past that’s got use where we are today and the Deer Herd still strives! “Why not? I think the answer is in the foot pounds of energy produced, mot so much at the muzzle but at the average range the deer can be expected to be shot. Like any other weapon, I the hands of a capable hunter it could kill deer regularly but you always have "that guy" that would take the 150 yd shot or Texas heart shot or some other poor shot and wound and lose deer. As for bullets there would be no advantage using new over round balls unless you could make the new fly faster to get better mushrooming and deeper penatration. I killed a lot of deer with a 54 round ball and recovered so.e of the bullets. Some had flattened out to al most the size of a quarter and others were pretty much round with a little deformation. Why? I have no idea. Me personally, un less you can get the bullet (a modern one) screaming I would rather be in the woods with a big bore and have a bigger hole with more thump at a any given range. I also feel that with the old smoke pole you need to be a better hunter because you need to be closer to the deer for the shot. I bet if you knew the truth,cva is not makeing the 40 specifically for deer hunting as it has introduced it to have another DIFFERENT gun on the market for sales ie profit. Just like the 6.5 Creedmoor. When you get down to brass tacks it is almost identical to the 270 in bilistics , trajectory and bullet weights but a new gun with the 6.5 hype is makeing lots of money over the old 270. It is the gun companies job to invent new gun/cartridges to improve profit. Sad to say but some of us have to have that NEW one when we have a better one in the safe because the old one is not COOL! sorry about the ramble I just like to explain my opinion in detail and let you know the reasoning behind that opinion. Onebentarrow The metrics numbers have a better appeal to rhe younger generation. I can only assume it because of rhe newness of rhe lack of ability to math and do the conversion. It's a lot like tires. When I had my Durango a bunch of people kept telling me to put a set of 31/10.5 on it. My question was why would I go smaller, my metric designation tires were about 32.5/11. It's all about perspective and what someone understands.
