Interesting about the adverse possession, me and dad may want to look into our property being surveyed. We've let a farmer use our land for around 10 years. He understands that it is our property under the pretense he lets us hunt some land he has that adjoins ours. Your situation doesn't meet the requirements for adverse possession since you have given permission for the farmer to use the land

Squirrelhunter, legally a title search of the original owner of the overlap area (before it was split) will determine ownership. And yes, surveyors are not allowed right of trespass in indiana so it becomes a Sheriff or CO responsibility or court order just to do a dispute job. That's why even though my deed says I'm owner of it too I'm not going to worry about it or act like it's my land,I know our property is suppose to stop at the corner post,they messed up our deed when Wilkinsons sold it to dad,the overlap is suppose to be theirs.

That's part of the reason I had our placed surveyed before Char had lived over at Bill's very long. A couple years ago he wanted to widen the end of his lane because the semis had a hard time turning into his lane at harvest time and not tear up the yard at the property line. He asked if he could widen it over onto our property a little to save our yard too and I said he could. Even though I know he wouldn't claim it was his later,since I gave him permission that stopped his ability to anyway. Char doesn't know about the agreement so she would probably say she owned over to my side of it so I wanted it showed that she didn't.

In the process of surveying a deed has surfaced. It was never recorded and the markers are off. I have a plan that benefits everyone so hopefully the other parties agree.

What’s recorded is what counts !! My property description said line followed the meanderings of a creek A surveyor When the creek got close to the road recorded the line followed the road . That stood up . Because that line was recorded aA fence used as a property line will not trump a survey A fence is nothing more than a good place for a fence ..

Seller and the neighbor have agreed to redeed the property in question at no cost to me prior to closing. I got a reduction on the price of the house due to smaller than advertised lot as well as the eventual reduction in property taxes, oh and I can buy a smaller lawn mower now and have good relations with me new neighbor. Everyone avoids a legal battle. Its a win all the way around.

We have an alleyway between my neighbor and myself it has been neglected by the town so we took it over and made it mine. Then there is a fence that surrounds most of my property and the only time it is mine is when something needs done to it. But when it was installed it was a cooperative effort.

Turns out I was worried for nothing. A face to face and a hand shake is still worth something. We closed on the house today with the full 1.13 acres and I will be leasing the current pasture to the neighbor for a nominal fee to cover my property taxes for that parcel.

Turns out I was worried for nothing. A face to face and a hand shake is still worth something. We closed on the house today with the full 1.13 acres and I will be leasing the current pasture to the neighbor for a nominal fee to cover my property taxes for that parcel. Theres still some trustworthy people out there.
