Just from the article and not really knowing both sides of the story this seems a little over zealous to me.
Mixed emotions on the videoing of this. That seems to me that it might lead to being "tougher" on an offense than what is really necessary.

Yep, sent the DNR my dislike for temporary transport tag. Crazy law that is not needed and too much gray area.

I wonder when the Co took posesin of the elk when he wrote the ticket or after the two gentleman got it out of the field.
I always thought that if u were not convicted of a crime that any thing confiscated from u was to be returned so they should have held the meat in cold storage as evidence till the procideings were complete at which time he should have received the meat hide and horns.
I do not think the Co was pressured by the film crew to Wright the ticket but I do feel he was influenced by there presents and wrote the ticket so he would not be perceived as not doing his job

From a technical standpoint the way our regulation is worded is impossible to follow.... that is my problem with ours and any that are worded similar. It is left up to officer discretion which in most cases is just fine but I hate leaving my compliance of the law to the opinion of another person.
I don't think its too much to ask that laws and regulations be worded in such a way that they are possible for a hunter to actually follow them without the need for opinion to factor in.

Along the same lines what if you had forgotten paper and pencil would a note on a smart phone suffice?? I think he more than likely knew the elk should have a punchepunched tag

I was wrongfully accused on a bear, all the meat had already been eaten a year after the animal was taken but they took the frozen hide, they returned it in their own sweet time...but it was rotten with crap leaking out of the cardboard box and the hide was completely thawed out!! Guess it was their way of being sure I got my hide back....but really didn't. When contacted I got a soory..F that!! |

If you read through the comments it seems like many others have had issues with the same officer. Sometimes you just get one that takes the law to the extreme and doesn't use any discretion. Those instances usually result in no prosecution.

I can't believe the difference between law enforcement officers and the BS I have to deal with as a state regulator. I have to deal with the "intent" of the law and "substantial compliance" with recalcitrant responsible parties that knowingly and willingly attempt to evade and not comply with state regulations. They got off scot-free and the state ends up paying to clean up their mess.

Yeah I'd say the TV camera clouded the ' Warden's" decision making. Immediately means what? 1 min, 2 min, 3 min? What if it takes you 25 minutes to cross the mountain to get to the Elk you shot? If the man had bad intentions then yes write him a ticket and take the meat....obviously he was so excited and collecting his thoughts as to how to get the Elk out he did not get it tagged immediately...BS if you ask me....These TV shows and camera make people do things they normally would not...bad idea

Also, for them to use the term "immediately upon kill" the phrase/term should be defined in the regulation. What I deal with, there is an explicit time frame of 24 hours for compliance; however, "substantial compliance" gives them 14 days.
I typically wait 21 minutes or more to get down and begin tracking! Besides, I'm a geologist, 21 minutes is immediate!

Immediate is the instant of death.....and impossible for a hunter to identify and comply with.
There is absolutely no way a hunter can identify the second an animal dies and either fill out a tag or place that tag on an animal.
It is impossible.

You guys it's really simple. All you need to do is pick out the deer you are going to kill that day and affix the tag to it while it is alive, then shoot it. 100% compliant with the law and the COs won't get all confused wondering if you have someone else's deer when he watches you kill it through the binocs.

Or you can also affix the tag to your bolt or arrow and shoot the deer with it so it remains lodged in the deer. For firearms you simply hit the deer in the butt with an arrow that has your tag and then shoot the deer with the gun. See, there are 2 ways to be compliant with the law! ;-)

Personally I see no reason a tag shouldn't have been notched or filled out if your standing over the game or gutting it..... To me that's common since

Maybe it's my personal bias, but I am sick of people being mad because laws were enforced and then saying the enforcement officers should just calm down and let things slide. Seriously, are hunters going to riot and start burning down the forests?
