Intent is everything. No way is my county CO (yes I know him) will walk a 1/2 mile back on my property to look a rotten stinking deer to give his OK to bring in just the rack for check in.
If I did what the OP did my CO would say OK - guaranteed.
As for as the EHD thing the "black and white law" does not change because of manpower constraint or does it? That was a confliction of what is required in this instance. The DNR should not say one thing one time and then another thing another time.

the correct and simple solution to this whole fiasco would have been to call a CO when the carcass was found..NOT THE CHECK STATION. Check stations arent law enforcement, cant legally make that determination, and can not ticket you as one poster claimed. And why as sportsman and hunters, now that we know the law, openly say we would continue to INTENTTIONLY break it instead of making a simple phone call.

I have to admit your county CO is nicer than mine, I met him for the first and only time (so far) year before last. I was sitting in my truck in the edge of a field, eating a sandwich. When he seen me in the truck as he drove by he turned around and pulled up behind me. After the convo and checking my liscense. He ran my plates, evidently. You could imagine my suprise when he brought me a ticket for invalid plates and registration because I mixed the plates to my boat trailer and the utility trailer. When I told him that is what must have happened, he said I could go to court and show the judge and it would probably be discarded. It was, but I had to waste my time for something so petty. I couldn't imagine what would have happened in this situation.

First CONGRATS to a great deer, sorry to hear you had soo much trouble in finding him, and I personally believe you gave a valiant effort in recovering the animal, I dont know if I would of even known how to contact a tracking dog myself or if I would have had the funds to do so at the time. I can see how and why some hunters use and believe the tracking dog is the way to go.
I dont think that you made a poor decision in calling the check staion for advice on what to do withthe decaying carcass, I can see now that most people would agree if in the situation again call the CO, I also know that especially in the field I wouldnt have known the proper phone number to contact the CO but I do however have the number to the check station in my area that I use. I think I may add the numbers to contact the CO into my cell phone for if this happens to occur to me one day !
Another thing I agree with is that the check station system is flawed in Indiana, and I would think that some may be more laxed than others but Im not the type that needs to find one thats laxed to get by with something. I go by the law everytime, to the best of my undestanding and I try to clarify with the IDNR whenever I have an issue undersatnding a particaular law. I agree that that there are grey areas in the laws, regulations or rules of deer hunting and there is alot left up to the Co in personally interruptation of said laws.
With the check in system I remember when I first started hunting when checking in a deer the check station attendant always came out to see the deer & would actually lock on the tag personally & now even at the same check staion I have used since I beagn hunting they no longer do that, occasionally they do but most often they dont. I think by them not coming out to look at the they rely on the hunter being completely honest as to what sex the deer is, where & what it was taken with. And I think that some so called hunters use this to tag a buck as a doe & can use it to in a way to poach an animal IMO, and I can bet there has indeed been cases where its happened that way, and IMO thats just wrong on so many levels.
I realize alot of hunters think that telecheck is a great way to check in a deer and to a certain extent I can agree it is more convienant and offers other perks but I also think that it opens the door for "poachers" to check in bucks as antlerless deer, and can also allow them to simply take the deer home & not tag it at all since it will no longer need to be tagged at a check in station !! Once the deer is takin to the house I can see those ppl "poachin" simply processing it and saving their tag to continue to hunt with and with a one buck rule still in effect in Indiana there will be ppl not taggin smaller bucks at all or taggin them as if they are antlerless so they can still hunt for a larger or another buck !!
And of course I think that type of stuff is just simply BS and one of the reasons I think check stations should remain and they should be required to still come out to the vehicle and inspect the deer carcass to in fact make sure it is what it is and wasnt taken with a firearm during bow season etc.
But back to the post ANTLER I want to aopolgize to you for catching the noose on this thread over what you shoulda, or coulda done better, or differently, and I hate to think that you feel like a criminal for taggin the antlers, not finding you awesom buck before it spoiled, and having to read thru alot of BS to get advice on finding your buck in the beginning and the harsh words and criticism after you did in fact find him !
Im glad that you did the right thing taggin it, not giving up on finding the deer, and obtaining permission to look for your deer on the adjoining property before goin after the buck, and I can appreciate that you were in fact looking out for the farmers livelyhood when not bringin a small army to search for the deer yet you never gave up the pursuit ! Good Luck to you nxt time in harvesting another buck of a lifetime next year with better ending results, now get back out there and take a few does to fill the freezer & provide red meat for the family !!
Good LUck the rest of the season & God Bless.......... ~INDeerhunter ~
