The antlered deer would be the only antlered deer that the youth hunter could take that year in all of the deer seasons combined. The DNR received a petition requesting this change and in a survey of deer hunters, found that the majority were supportive of this change. Additional changes clarify the requirements for adults that accompany youth hunters and requires the adult to have a valid hunting license, the same as currently required for apprentice license holders and youth hunters during the free youth hunting days. The Warsaw urban deer zone is also being added to the list of urban deer zones in subsection (e) at the request of the city and with the support of both the Division of Fish and Wildlife and Law Enforcement. Note that this agenda item will radically restructure the deer rules in the code for easier reference. Significant improvement we can all support. Jack

Changing that law is a good deal. My grandson had to pass on a buck in each of the last two youth seasons and it was the only shot he had on any deer. This past season was especially painful as I watched him still hunt up to within 15 yds of a nice 8 pointer.

Consideration for preliminary adoption of amendments to 312 IAC 9 governing the taking of whitetailed deer and hunter education requirements; Administrative Cause No. 08-189D
The changes to the proposed rules in this package from the Department of Natural Resources (DNR) govern the hunting of white-tailed deer. In an effort to simplify the deer hunting rules, all of the current rule language has been combined into the four following rules: general requirements and licenses; equipment; season dates and bag limits; and hunting deer on designated military reserves and National Wildlife Refuges. The current deer hunting rules are very complicated, and these proposed changes will clarify the language for hunters.
312 IAC 9-3-2: These changes add the apprentice license to the list of license types that are legal for hunting deer. Additional language was added to clarify license and tagging requirements and make it clear that a hunter who tags a deer must include the name and license number of the person who killed the deer (not someone else) on the tag, and the person who takes the deer to the check station must give the check station operator true and accurate information about who killed the deer.
312 IAC 9-3-2.5: All of the provisions for the youth deer season have been added into the other rules governing deer hunting in 312 IAC 9-3-2, 9-3-3 and 9-3-4.
312 IAC 9-3-3: The new provisions add rifles (with pistol cartridges) to the list of legal equipment that can be used to take a deer during the special youth deer season. This has been allowed by emergency rule the past two years. These rifles are the same ones that are allowed by other deer hunters during the regular deer firearms season. The following additional changes were made: (1) allow archery equipment to be used during the firearms and muzzleloader seasons; (2) allow arrows to be capable of being shot (with the nock in the bow string) outside lawful shooting hours; (3) allow shotguns and muzzleloaders to be capable of being fired outside of lawful shooting hours. Therefore, all equipment authorized for deer hunting would be capable of being shot or fired outside lawful shooting hours, the same as is currently allowed for rifles and handguns. Additionally, both archery equipment and a firearm could be possessed during the firearms season as long as the person has both an archery license and a firearm license; a person could possess both archery equipment and a muzzleloader during the muzzleloader season with a muzzleloader license and archery license,
312 IAC 9-3-4: The new provision would allow a youth hunters to take either an antlerless or antlered deer during the special youth deer season. 312 IAC 9-3-5: This provision has been added to 312 IAC 9-3-4, so a separate rule is no longer needed.
312 IAC 9-3-6: These provisions have been repealed since the department is no longer using depredation zones.
312 IAC 9-3-7: This provision has been added to 312 IAC 9-3-4 (h) and a separate rule is no longer needed.
312 IAC 9-3-8: This rule change eliminates the list of specific military reserves and national wildlife refuges by simply changing the terminology that is used. A change has been proposed to allow the use of firearms for hunting deer on a military reserve or national wildlife refuge beginning on October 1 instead of November 1 of each year.
312 IAC 9-3-9: The rule language only adds district wildlife biologists, property managers, and assistant property managers to the list of employees that can issue a free permit for a person to possess a deer killed by a collision with a motor vehicle or for one that is found dead.
312 IAC 9-12-2: This rule change exempts an individual from having to take a hunter education course if they purchase an apprentice hunting license authorized under IC 14-22-12-1.7, comply with the requirements for hunting, and are accompanied by an individual who is at least 18 years of age and holds a valid hunting license (or is exempt from needing a license).
312 IAC 9-12-3: This rule change adds the provision for a license agent to issue an apprentice hunting license to an individual who has not taken a hunter education course.
PROPOSED DEER HUNTING AND HUNTER EDUCATION RULE CHANGES
January 2009
Condenses the deer hunting rules into 4 rules as follows:
312 IAC 9-3-2 General Requirements and Licenses for Hunting Deer 312 IAC 9-3-3 Equipment for Deer Hunting 312 IAC 9-3-4 Season Dates and Bag Limits 312 IAC 9-3-8 Hunting deer on designated military reserves and National Wildlife Refuges with extra deer hunting licenses Youth Hunting Season - Allows a youth hunter to take either a buck or a doe during the special youth deer season. If the youth hunter take a buck during this special season, the youth hunter could not take another buck during any of the other seasons that year (except during the urban deer season in an urban deer zone). - Puts in permanent rule the ability for a youth hunter to use a rifle with the cartridges specified in the rule General Deer Hunting - Allows archery equipment and firearms to be loaded, or capable of being fired, before and after lawful shooting hours - Allows legal archery equipment and a firearm to be possessed during the firearms season, as long as the person possesses both an archery and a firearm license - Allows legal archery equipment and a muzzleloader to be possessed during the muzzleloader season, as long as the person possesses both an archery and a muzzleloader license - Clarifies that a handgun cannot be a rifle that has been modified to meet the State of Indiana’s definition of a handgun - Clarifies licensing and tagging requirements to make sure that the person who killed the deer puts his/her name on the tag and that the deer is recorded at the check station in the name of the person who actually killed the deer - Adds the city of Warsaw as an urban deer zone in Kosciusko county - Removes names of national wildlife refuges and military areas to simply say “designated military reserves and National Wildlife Refuges” - Allows a person to use a firearm from October 1 through December 31 on a military reserve or national wildlife refuge, instead of November 1 through December 31 - For deer killed by a vehicle or found dead, adds district wildlife biologists and property managers and assistant property managers to the list of people who can issue permits Hunter Education - Allows a person to purchase an apprentice hunting license in accordance with IC 14-22- 12-1.7 and be exempt from hunter education requirements - Allows a license retailer to issue an apprentice hunting license to a person who has not met the hunter education requirements

I would support letting the youth shoot two deer on youth weekend ....Buck&Doe!!! why stop at one Deer? ?

Most seem pretty good... some are puzzling though:
General Deer Hunting
- Allows archery equipment and firearms to be loaded, or capable of being fired, before and after lawful shooting hours Why? You can carry your CCW and you can't shoot game anyway, so Why?
- Clarifies that a handgun cannot be a rifle that has been modified to meet the State of Indiana’s definition of a handgun OK, I can understand this... but to do this legally previously required a BATFE Rectal Exam, so in some respects anyone willing to undergo The Probe should be allowed to do whatever... and if a CO finds someone in possession of one without the BATFE Stamp... well... I hear Federal Prison can be a life changer...
- Clarifies licensing and tagging requirements to make sure that the person who killed the deer puts his/her name on the tag and that the deer is recorded at the check station in the name of the person who actually killed the deer So much for TeleCheck?
