Eight People Arrested at Driftwood State Fishing Area for Public Indecency
Indiana Conservation Officers, responding to complaints from the general public, arrested eight subjects at Driftwood Public Fishing Area on September 18th and 19th. This property sits right on the Johnson County, Bartholomew County line on Highway 31 near Edinburgh. The subjects were arrested for indecent exposure and/or battery. In addition, all subjects that were cited were also ejected from the property for a year. Battery ( I.C. 35-42-2-1) is a Class B Misdemeanor and Public Indecency (I.C. 35-45-4-1) is a Class A Misdemeanor. Both of these charges require the accused to appear in court. One subject was also arrested for Public Nudity (I.C. 35-45-4-1.5) and is a Class A Misdemeanor.
The Department of Natural Resources goal in enforcing public indecency is to send a message that state properties are for family use. Those traveling to this area to engage in illegal activities should expect to be arrested, jailed, and prosecuted to the highest degree that the law allows.
The following is a list of subjects cited and their charges:
John D. McFarland, age 53, of Columbus, Public Indecency and Battery
Heit Vo Nguyen, age 34, of Columbus, Public Indecency, Battery, and Resisting Law Enforcement
Thomas Holtkamp, age 73, of Noblesville, Public Indecency and Battery
Gerald E. Lacey, age 56, of Indianapolis, Public Indecency
Marion D. Dobbs, age 55, of Columbus, Public Indecency and Public Nudity
Joey T. Williams, age 44, of Taylorsville, Public Indecency
Doyle A Ballard, age 37, of Columbus, Public Indecency
Morgan C. Hanner, age 23, of Columbus, Public Indecency
Because the Driftwood property straddles the county line, the defendants were cited into one of two courts. Most of the cases went to Franklin City Court in Johnson County and a few went to Bartholomew County Court. Mr. McFarland and Mr. Nguyen were incarcerated at Johnson County lockup. Mr. McFarland was jailed due to the fact he had prior arrests for Public Indecency. Mr. Nguyen was jailed after he attempted to flee in his vehicle.
