Wilbur Carson, 61, shot and killed intruder Wilbur Copeland, 42, in a home in the 3100 block of North Park Avenue at 11:27 p.m., Indianapolis Metropolitan Police Sgt. Matthew Mount said. The intruder entered Carson’s home through an upstairs window, Mount said. Carson confronted the burglar and fired a .22-caliber rifle. Copeland, 3300 block of North Park, died of a gunshot to the chest, according to the Marion County coroner’s office. Copeland was not armed, Mount said. Carson has not been arrested.

Naw,he should have laid down in the fetal position while calling the cops ,Then they could have prosecuted the intruder if they ever found him for murdering a guy with a ice pick to his head with a cell phone in his hand.

What you say and how you say it when being interviewed by the police is what most of the time determines whether or not charges will be filed. Prosecutors know they will have a hard time getting a conviction in situations like these. As long as you had a reasonable fear that your life was in immediate danger and your statement re-iterates that point then it's likely going to be considered justifiable. Seriously, there aren't too many juries that are going to convict a man of homicide when he was confronted by an intruder in his home at 11:30 at night, armed or not. It always helps though when there's only side side of the story to be told. Obviously this homeowner said the right things.

The old coot that killed the intruder is a real piece of work. Amen that he was able to defend himself like that, but trust me.....the guy has SEVERAL screws loose. He would only talk to our reporter from a distance today, and after he gave a few comments the reporter asked, "Sir, can you tell me if you have had any previous trouble with the man..." to which the guy smirked through a toothless grin and he made a VERY obscene comment about the reporters wife and her ummmm, I can't think of a nice way to say it. Anyway, it was unprovoked and totally uncalled for. The guy is a nut-job. I was told that he threatened the female Fox 59 reporter with a knife earlier in the day.

Travis - yeah, I saw their tickler, but missed the actual interview, but he had some sort of razor knife and made some remark about "I ought to cut your throat right now..." to the Fox reporter...
I think he may have got away with one... the story on 13 said that the guy shot had worked for him and was there earlier to collect his money, so didn't sound as clear cut as first made out... definitely wasn't a case of an unknown intruder in house... old guy sounded like he'd been hitting the firebird before the reporters showed up for the followup...
Don't get me wrong - I'm all for self-defense rights, but this case, to me, sounds like somebody owed someone money, they got in an argument, and the homeowner capped him.... and like Action said, the last man standing gets to tell the tale... will be interesting to see if his story holds up in the next few days...

Hard to say from the brevity of detail and one side only being told. If someone entered my home in the manner described at any hour then they take the chance of getting shot since they are now a direct threat to our safety.
