No, there is no legal issue in the memorial (at least not criminal - now you can sue anyone for anything these days); what law would it fall under?

No, there is no legal issue in the memorial (at least not criminal - now you can sue anyone for anything these days); what law would it fall under? No LAW-as I stated, it`s an First Amendment issue. Absolutely in poor taste-but no less a First Amendment issue than the "poor" kid who was jailed for writing the essay on his desire to murder students and have sex with their corpses. Is it acceptable to allow ANYTHING under the First Amendment, or isn`t it? And who decideds if we draw a line?

In another time, his body would have been hung outside the town, to show the fate of those such as him. And rightly so. But, that would be oh so NOT pc. . .
We live in an age of information, and of discovery. But not so much wisdom. Many things we have been doing the last 50 years are adamantly proven to be unworkable, yet still we do them. Laws which are useless we still attempt to enforce. Illegal immigration, nafta, the war on drugs, our penal system, unrestricted youth, etc.
We need to come together, and make a great change in our laws, and soon. Our country is in dire straights, and the EASY answers and PC answers ain't WORKING! Know why stealing was once punishable by cutting off your hand? Because a slap on the wrist was KNOWN NOT TO WORK. What part of human wisdom has all of our 'vast knowledge' cost us?
While the 'hard' answers are oftentimes distasteful and unwanted, for some things they are the ONLY REAL answer. Spanking your child is a distasteful thing, but there are times it is still the only REAL answer, regardless of the number of reasons one can conjur up NOT to do so. Many have adopted a pc approach to that also, and it shows.

480; the 2 events are about 2 different issues. 1 is about legality, the other propriety. No legality in the memorial to the killer? Can`t have it both ways now-either it`s legal all the time, or not at all. Poor taste doesn`t enter into legal disputes. Mass Murder rather draws the line I think. Anyone can say or do as they wish. His body should be hanging outside town, defiled in every way, as a 'testament'. (btw, one of us better be getting a turkey soon, as I just looked and no one on our team has turned in a bird yet. . . . )

The boy writing the essay was arrested, that makes it a criminal case; the memorial has no criminal law element to it at all. That is a huge difference to me. The former is government out of control, the latter is poor taste; but they can do what they wish. I never said they should be forced to remove it.
