I'm confused. Why couldn't the remaining arms be lifted up a bit, unlocked, and lowered to get the vehicle on the ground, THEN the vehicle dragged out and turned right side up?
If I was the shop owner, I'd be looking at the rest of the lifts (if any) that were also in the shop. Those gears were to swing the arms apart to adjust them, correct? Not the gears to hold the lift up in the air?
I believe my neighbors lift is a Bendpack brand.

Here’s what the lock gears look like. The smaller gear on the left was stripped cleaned and smooth and the bigger gear had some broken teeth. My guess is they have been wore out for awhile and it finally went. I'm guessing they do not have any equipment inspection procedures in place?

Yes those gears are for rotating the arms. It has a knob that you pull up to unlock the gear to adjust the arm, but it sheared the teeth so it free swung out. The rear of the truck was through the ceiling so it wouldn’t go up any and the front arm on the right side slid between the tail shaft of the tranny, drive shaft and the cab wedging it in several different ways.

Man that sucks, glad nobody was hurt though. In this economy that seems like a rough way to go but again, no one was hurt and there's a lot to be said for that.

I snapped a picture of the gear today at the shop. I don’t think that just happened. I’ll bet it’s been wearing for quite awhile. My guess - Non-inspection and set maintenance of his equipment is the root cause.

Received the insurance’s quote on Friday and will now start the haggling process with them for a higher payout. Had a talk with the garage owner (which is my bro-in-law’s stepdad whom we’ve know forever) about the current offer we got from insurance. We explained we weren’t happy about it and he is going to help out the best he can when the insurance is maxed out. So we’ll see what happens in the coming days!

You could sue about three different parties right now And spend a bunch $&$ in legal fees and loss of work time. But yes you could sue…. The lift maker may pay if someone can find fault

The more talking that takes place the more I realize that inspection and maintenance on the lift has been neglected. Therefore I would guess the lift manufacturer would be off the hook. Like Greg said…how much time and money do I need to invest in this crappy situation. I’m trying the patience route right now as hard as it is. I believe it will get worked out for us.

A friend is an underwriter for an insurance company that specializes in business insurance. He said the shops general liability insurance should cover it.

Update: thing’s went sour and the shop owner refused to pay anything out of his pocket to make up the difference of what the insurance was offering and what we were asking. I had to hire a lawyer and finally a couple of days ago his insurance settled with us outside of court. They kept low-balling us until they realized they didn’t want this to go to court. This whole thing was extremely exhausting for us and has caused hard feelings between us and my sister’s family unfortunately. I guess my bro-in-law thought we should just accept the low-ball offer from his stepdad/insurance, but that wasn’t happening!! Somehow my wife and I are the bad guys in this. Signed paperwork yesterday and should receive a check next week. Just a bad deal all the way around!!
….And by the way…insurance sucks!!
